Theft By Check Charges in Texas

Texas - My 20 year old daughter was arrested back in 2005 for theft by check, spent the night in jail, I bailed her out and "we" paid everything she owed back. She was arrested again last week for the same thing. Is this a misdemeanor or felony? Is she looking at a possible jail time because she has commited the same crime twice? Should she hire an attorney or is this something she can take care of on her own? I'm struggling with the decision of whether or not to help her this time but want to know what kind of trouble she's in and what the potential consequences are. Thank you.

I believe you exceeded your obligations last time and, since she apparently didn't learn her lesson, should consider letting her dig her own way out this time.
