I'm new here and really don't know the procedure, but am desparate so here is the issue. My fiance was involved in a car accident 2 weeks ago. She pulled out "in front of" another driver. There was a hill involved and the other person was speeding, but whose fault is not the point. This all happened in Pennsylvania. After the other car rolled her car, she was taken to trauma center, and was ok except for some cuts..same with the other person. After the insurance companies duked it out for a week, she was blamed, and the Erie police told her to expect a ticket in the mail for failure to yield, or something to that effect. We live in Western NY so on the weekends she comes home from attending graduate school in Erie. As of Friday, August 3rd, she has not received a ticket at her apartments address in Erie. Now, today is the 6th(Monday) and there is a postcard from the local judge's office in her mailbox in Erie telling her that a warrant was issued for her arrest for failure to respond to the ticket! When we called this evening, the judge's clerk told us that they closed at 4:30pm and since it was 4:15 to just wait until the morning and come in. She also told us that the ticket had been returned undeliverable, and she had it at the judge's office. I am afraid that when my fiance goes there in morning, they will try and arrest her, when in fact we never received ticket, and are furthermore want to plead NOT GUILTY on the ticket, since we have sufficient proof that the other car was speeding in a 20 mph zone when he hit her. Living in NY we are not familar with PA law, and I am just looking for some assurance that they won't handcuff her tomorrow morning. She is planning on going tomorrow morning at 830 am when they open, and has class at 1030am..with 4 weeks left before she graduates, she cant afford to miss class if they decide to go nuts on her. What is the best course of action here. Hopefully someone can give us some advice before the morning. Thanks in advance
