I have a house in CA that I rent out since June 7, 2007.

On August 1st, my tenet sent me a letter notifying me that he is leaving the house on the end of August, 2007, and the deposit that was paid by him with the signing on the rental agreement will cover the rent payment for August. Also in the letter he requested that from now on all the communication between us will be by first mail letter only, and not by phone.

By using the deposit as a rental payment, the tenet is violating one of the terms in the contract.

I did send a letter back with mentioning that according the contract he is not allowed to use the deposit as a monthly rent, and he should pay the rent and will get the deposit back after the house will be inspected by us.

I didn't receive any comment from him.

Please advice what should I do? should I start the "three days pay or quit" process, since the rental agreement has been violated, and the tent won't pay the rent? I must admit that I really concern that the tent won't leave the house (although he mentioned he is going to leave in the notice letter )and won't pay the rent.
