    Default Son's Name Changed Without Father's Consent in Florida

    On a recent visit with my twenty-three year old step son my husband I discovered his name on his social security card and drivers license had been changed to his mothers married name. She in the past had claimed that the married name had only been used in school as an a.k.a..My husband was not comfortable with this but did not protest. We are trying to figure out how she did this without my husbands consent. While he only sees his son once or twice a year she has always had contact with him.

    That being said, this is the other issue,about eight months ago out of the blue, she has decided to go after my husband for several years of back child-support. First - without the use of the courts and willing to negotiate the amount, my husband was not in agreement with the amount, so she has now gone through the courts. I understand her rights to go after any monies owed to her, however, I am curious as to what my husbands rights are if she has done a legal name change or step-parent adoption without his consent .

    With him being an adult, he could have easily changed his own name. He would not need his dad's permission to do so as he is an adult.

    Do you know when the name change occurred?

    Thank you for your response.

    We thought of that , of course he might have and didn't tell us.But when we noticed the name on the social and inquired he said that is what it has always been.Actually my husband said to him before he realized what was on the social that he was concerned about his future with two last names and his son agreed to having the same concerns.

    I've known him since he was eleven and he has never gone by my husbands last name.
