    Default What Will Show Up On A Background Check After Dismissal

    My boyfriend was arrested for possession of meth in 4/06 in Oregon.
    He went through treatment and drug court successfully. At his graduation, they told him his charge was "dismissed" and he had no other arrests or other record of any kind.
    Now, we are looking into a process called "expungement" that, I guess, is supposed to wipe the arrest off his record but it takes about 4+ months from what we've heard.
    He's sober now and is desperately looking for work (he was a professional before, but this has ruined him.)
    With the above facts, what would a current general employment criminal background check show? What about after the expungement? This is all exclusive to Multnomah County, Oregon... I tried purchasing a background check from online but you needed to be an employer to get it. What can he do to get his record clean again?

    After the dismissal, I would expect his record to show the initial charge, possibly the charge he plead to, and the disposition as a dismissal. After an expungement, "Upon entry of such an order [of expungement], such conviction, arrest or other proceeding shall be deemed not to have occurred, and the applicant may answer accordingly any questions relating to their occurrence." Oregon Revised Statutes, Section 137.225

    Thank you, that's what we've been looking to work out. The background issue isnt relevant to regaining his license since they are well aware of his ongoing situation nowadays, but for finding a job in the year it may be before he can fill their requirements to practice again, it's been a struggle to find a place without a background check that will hire someone with no real work experience (outside of his field.)

    If you happen to know...

    He went in and started the expungement process today. The lawyer there told him it should be no more than 8 weeks before he gets a notice of expungement in the mail, but we are still unclear as to when long enough will have passed to be able to apply at a job without having the record still come up on a check. I imagine the record's expungement is not immediate and so charges would still show up for some period of time after the 8 weeks. Do you know when he will most likely be in the clear to apply at jobs that require a BG check again?
