    Exclamation Changing my Daughter's Last Name, in Florida

    When my daughter was born, her father and I were on cordial terms, and I gave her his last name. However, since then he has proven himself to be...well unworthy of this and I would like to change it to, at the very least, a hyphenated last name of both of our surnames. He is not listed on the birth certificate since he never came in to sign it, however I gave his name as her father to child support. Since he never signed the birth certificate, could I change her name without him having to sign the papers?

    Not without his consent or over his objection, that is, without going before a court and convincing the judge that the name change is in the child's best interest.

    Because hes the Father and he has rights. You cannot take his legal rights away!

    Because in order to change your child's last name you will have to get permission form the court. They will want the father to be heard.

    Court? They never mentioned court...I have a paper to fill out, that has be notarized and turned in...they never mentioned a court appearance, and since he is not listed on the birth certificate would it not be as if I did not know who the father was?

    As I said before you don't get to decide when his rights can be removed! If you go to court and play you dont know Father etc you could find yourself in trouble
