    Default Put In Resignation Papers, Fired A Week Later

    To make a long story short, an investigation got started because people were claiming that I made jokes about a co-worker possibly being gay. To be up-front with you all, that never happened. I have had numerous people ask me if I thought she was, but I would always blow the questions off and just let them go. And I never accused her of any such thing. However, they did start a formal "investigation" to see what kind of history the other supervisor and I had, because we had never gotten along well.

    Anyways, I was making plans to join the military reserves and then relocate to North Carolina (from Michigan) for better career options. I then put in three weeks notice, which is the requested notice for supervisors at my job, and went about my business being sure to keep my actions 100% clean. I did not talk about anything to anyone, ect... Almost a week later, my supervisors pulled me into their office and fired me for violation of the "sexual or other harassment" policy. Now, even if I did joke that another individual might be gay (which I did not), I don't believe that qualifies as sexual harassment. However, because they have a generic "sexual or other harassment" policy, it looks like that is why I got fired.

    My question is two-fold.

    1 - Can they do a write-up and termination following an employee giving their requested notice of resignation? This seems odd to me, because giving notice is meant to be a favor to the employer, and it appears that I would have been better off if I gave no notice at all.

    2 - Is there any way to get the "sexual or other harassment" accusation off of my file. I have since decided just to go active military, because of my high education and test scores. But something like this could interfere with getting the necessary military clearances for further advancement.

    I am not looking to try to get the former employer into any major trouble, I just want to keep my record clean.

    For a time reference, I put in my notice a week ago on Friday (7/20/2007) and was then terminated last Wednesday (7/25/2007). I worked Friday - Sunday, had Monday - Tuesday off, then was fired on Wednesday.

    Without knowing who said what no one here can safely say anything about charges. Harassment is sticky area and many innocent comments can qualify. Its your word against other(s) You might talk with HR see if they can change reasonning but they are not obligated to do so. They met their requirement they conducted an investigation and came up with results that they felt warranted your firing. You can hire an Attoreny to fight it but its he said she said and hard to prove.
