    Default Will It Matter If I Resign Or Get Fired

    California


    I'm dealing with a repetitive stress injury. Worker's Comp has, so far, paid for all my medical treatments. I was on light duty and received therapy. I had a major reduction in pain. I was put back on full duty with a few restrictions and my symptoms reappeared.

    Once again, I'm being put back on light duty.

    As I described in a previous post, the light duty is driving me bonkers.

    If I protest the light duty assignment, they might fire me.

    On the other hand, I could quit and go on with my life.

    Is there any difference to my Worker's Comp status if I quit or get fired?

    I'm close to retirement age. This job has no retirement and my pension will come from previous employment, so I can afford to leave this job at any time.

    The question is: is there any difference to me in getting fired vs. quitting?

    For the purpose of medical treatments, no, it will not make any difference either way. Your employer will continue to be responsible whether you quit, are fired, or remain employed.

    If you are receiving TTD payments, depending on your state law it might affect them if you quit.
