    I had a PRIVATE student loan discharged in a Chapter 7 bankruptcy which was filed before the 2005 law change. Now, I have a collection agency attempting to collect on this loan and is threatening to garnish my wages. They have contacted my employer, called once on the phone, and have refused to send me anything in writing (NCO). I understand private student loans are no longer dischargeable, but this was before the change in the laws. Do I have any remedy against this collection?

    As I stated before, they have not contacted me in writing, I have only received one threatening phone call stating they would be contacting "my payroll" office. They sent an employment verification to the store I work at (not the corporate office), that is the only way I know it is from NCO Financial Services. There was no account number, just my name, address (they do have it), and the last four numbers of my ssn. Right now, the return address on the letter they sent my employer is the only contact address I have for them. Sould I wait for something sent to me? Should I be proactive and request information? Sould I just send them the dispute letter? I really don't want to talk with them! By the way, I did inform them of the bankruptcy and even attempted to give them information on it, they refused to acknowlege it and told me it didn't matter.

    Thanks for the advice.

    I would personally be proactive, and send them a certified letter disputing the debt and telling them to stop contacting me. I would include a copy of the order of discharge.
