    Default New Spouse's Right to Privacy

    I am the new wife to a man who is involved in what seems to be never ending child support nightmare. Most recently my husband's ex, who is representing herself in court, has subpoenaed his bank statements. My husband is self employed; he has a business account and all of the money he makes goes directly in that account. We also have a joint account together. All deposits going into the joint account are MINE. He only uses the joint account to make purchases. The subpoena calls for all accounts in his name. My question is this, what about MY right to privacy?? I feel that handing over my bank statements to my husband's ex is a total infringement of my personal right to privacy. I do no want this stranger looking and questioning my deposits. Why should I have to prove my income when I am not a party?? My husband has had problems with "someone" applying for credit cards in his name that just happen to be at the address he used to live at with his ex wife. We have had to put a fraud alert on his credit because we suspect she has been behind this. And I am supposed to hand over MY personal banking information to someone like this!? What if she does not maintain the documents properly? Throws them away instead of shredding? Does anyone see my point?? I have since removed my husband from the joint account. All of our finances are separate to avoid this in the future, but she is requesting the last 2 years... Any thoughts??

    His name was on the account and she is well within her rights and the law in subpoenaing the records.

    Because your husband's name is (was) on the account, you'll have to produce the statements. HOWEVER, you do NOT have to allow any of YOUR PERSONAL info to be seen. You can take a black marker and "black out" any info that applies to you, such as a SS number, etc. If checks are listed with account numbers you can black out the account numbers, leaving only the name of the payee. You should also black out the bank account number. There is no reason that should be available to anyone, as you pointed out, she might lose it. And if the ex objects, it's extremely doubtful that a Judge would ever order the nuber to be given out.

    It's good that you removed his name from the account. Always keep your accounts seperate, just in case.

    Thank you for the responses. I want to be clear that I am trying to hide anything. If the records were going to be held by an attorney or a representative of the court (DCSS) then I probably wouldn't have a problem with it. It is the fact the SHE will have possession of these things. As I stated above, this is a person that I know (but cannot prove) has been, for lack of a better word, screwing with my husband's credit. I pay my credit cards online and noticed on my bank statements that the reference section on my bank statements gives almost the full account number. Actually for more than just credit cards, utilities, car payments, insurance, etc. . The account numbers for those things are there as well. I am just trying to avoid have my credit messed with. I will comply and just "black out" my information.
