    Default Petty Theft Infractions and Background Checks

    Well i ve been reading everyones posts and I can see that there is mixed reactions in regards to infractions. So here's my story...
    I was orginally charged in southern california with misedanor theft and got it brought down to an infraction. My lawyer said that this was the best deal possible so of course I took it. But now Im really panicing because I just got a job offer yesterday but they won't start my training until my backround check comes back green. This really worries me. The job is for a cell phone retailer and Im wondering if this is something which will make then want to revoke their offer. Im sure the infraction will come up because they conduct their backround checks with a company that checks into records extensively. I dont know what to do, I am on pins and needles. I talked to a someone esle who has an theft infraction on his record and he said i should be fine, he just recently got hired at macy's which gives me some piece of mind but what if my backround check is more intense?

    I m really going crazy over this and researching it for the past 4 hours! Can anyone give me any sound advise, preferably in a timely manner?

    Whether the arrest or conviction comes up will depend on the records accessed by the background agency. They cannot access state or local law enforcement records, so it won't come from those sources. However, COURT documents are public records so any record of a conviction - even for an infraction - might be revealed. However, employers are generally forbidden to ask about infractions or arrests, and may generally only ask about convictions for misdemeanors and felonies.

    I don't know.

    Affect.

    Maybe. Ask them. In an employment situation, disclose, disclose, disclose.

    If you lie and they later find out, you are a goner.

    Well i dont really know how to disclose it because the paperwork for the background check didnt ask about arrests or infractions, just about felonies and misdemeanors, so i never lied and was never given a proper venue to discuss this particular matter thinking it wouldnt make much of a difference and now im just really paranoid.

    BTW, you want to work for a cell phone retailer and you couldn't figure this out?

    How will explain how those frikkin cell phones work?

    I just figured if they dont ask for it outright then they dont want to know, I know what to say if I did have to disclose it. Thanks for the info, but I do resent the fact that u are putting into question my intelliegence and whether or not I can do the job I am seeking out. I just came on here for some input not criticism from someone who does't know me or the potiential I have.

    So thanks for taking the time out to answer my question to the best of ur ability, i'll be sure to look into this matter further.
