    Default Returning to Mexico

    Is it possible for someone who has been here illegally (for approx. 6 years) to return to Mexico and apply to enter the U.S. legally? What if it is detected that he has already been here? He is willing to do whatevever it takes to become legal.

    If his presence has been detected, he will be subject to a lengthy period of ineligibility to reenter.

    Is there any way to prevent being detected?

    If it it detected - how long is the ineligibility period?

    The period of ineligibility would appear to be the ten year period imposed by INA 212(a)(9)(B)(i)(II).
