    Unhappy Claim Deduction for Prior Damage

    Hi - first time posting!

    My parked car was hit, and I filed a claim with the other person's insurance company (State Farm). My car does not have collision coverage.

    The State Farm Adjustor is allowing zero dollars for the bumper and hood claiming that there was prior damage to both. They are both totally not fixable and will need to be replaced because of the collision.

    The bumper had a minor previous small (2" x 1/8") vertical crack in it that had been repaired with fiberglass and was ready for touch up paint. The hood, I have no idea what they are talking about since they have not given us any paperwork, and the hood had no prior damage that I am aware of.

    Do we have any recourse besides filing a claim with the Insurance Commisioner? We have tried several calls to State Farm, with absolutely no response from them. They do not seem willing to budge.

    State Farm will do everything possible to avoid paying a claim. Your only recourse is to file suit, probably in small claims, against the other party. If you go that route you will have to pay now to get the car fixed.
