    Default Paving an Easement

    we have an easement as part of our property description over 30 feet of the neighbor's land - ingress & egress and utilities. this easement has existed long before we brought the property. we have a horse trailer, a 20+ foot flatbed trailer and a 20+ foot boat trailer - the original owners did not have any of these. to exit our drive (steep hill up to gate) we must make a hard left turn onto the road. #1 our neighbor - property owner - had the road paved only up to 11 feet (total of 19 feet from our fence to grass berm). we had asked for an additional few feet to allow easier in and out - but apparently he didn't think we needed it. can we drive up over his berm if we need to in order to make the turn? #2 the paving ends in such a manner at our gate that will cause rain runoff to stream down our gravel driveway reslting in erosion. can we have the contractor fix this problem? #3 the paving has raised the level of the road surface to the point where our gate will not swing freely outward as it did before paving. can we have the contractor fix that as well? #4 he put in a speed bump that is rather painful - there is plenty of room on either side - can we go around?

    needless to say, we have a pretty adversarial relationship with this neighbor as does the rest of our small private road community. oh and we are in the state of Washington where it rains a lot. thank you. . . . gail.

    You have a 30 ft. easement and can use any part of that easement. I suggest you get written approval from the property owner to have your contractor pave the remainder of the road.

    thank you but we don't want to pave anything - i do, however, see your point and it's one absolutely worth considering. what about the artificial diversion of rainwater and the gate issue?
