Hi there... I'm incredibly new to these forums, but I'm in desperate need of some advice. This scenario is taking place in the state of Colorado.
In February of this year a roommate moved in after the end of the lease period. I had informed him that he would only be allowed to move in if he would agree to be put on the lease, etc... After a great deal of stalling from him, he agreed and a new application was filed for him(I did not need to file a new one myself as I was on the previous lease and just needed to sign a new agreement).
Months had gone by, and despite many calls to the leasing office and such... the finalized paperwork for the new roommate's lease was never brought over for him to sign.
This month we almost got evicted due to him. He did not pay his rent, which was due on the 3rd. He blatantly lied and assured me that it had been paid a few days late. Low and behold, four days ago a notice for payment or relinquishment of the property was brought to me on my day off. So not did his share of the rent not get paid, but there were now $250.00 worth of late fees added to it.
After a very long conversation with him he assured me that everything would be taken care of by today. Apparently he meant that he would just pack everything he owned and leave the apartment and hang me out to dry(as I am the only one on the lease after signing the renewal).
My question, after that long and tedious explanation, is what(if any) legal recourse do I have to collect owed rent plus late fees from him?
I greatly appreciate any advice you have to offer.
