    Default Divorced and Wanting Child Name Change

    I was just recently divorced in the state of PA and her father gave me full custody of her. He doesn't visit her and I get no support money, which is fine with me. At the time of her birth, he did sign the birth certificate, so she has her last name. I want to change her name. I know he has no problem with this.

    The other thing is if I ever got married again and my husband wanted my daughter to be his, would I have to get my ex-husbands name removed from the certificate or can my husband, at the time, adopt her?

    I'm trying to figure out the best order I should proced with. Name change first? Or remove the name from certificate? I would think removing his name from the certificate would make changing her name easy.

    Any help would be really be apprieciated. Thanks for taking to the time to read this.

    You can easily file for a basic name change as long as the father agrees. Contact your local court clerk's office to find out where to find the correct forms.

    If you remarry and your husband wants to adopt, most states require at least 1 year of marriage before a step parent adoption can be done. Also, the father would need to voluntarily relinquish his rights and give permission for the adoption. Of course, since you aren't remarried yet, you have alot of time to look into that.

    I called the my county court and they gave me a list of forms I need to do the name change. When I searched them on the internet, they have fees attached to them. Is there anyway to find these forms either on the internet or at a library? All the forms she said I needed was:

    Order of Hearing
    Order of Publication
    Petition of a Minor Name Change
    Order or Decree
    Verification

    With so few forms I should be able to do this all on my own. Any ideas? I only found one on the internet that I could print out, which was the Verification form. Not even sure if it is the right one. Any input would be great.

    Check to see what forms are available at the courthouse. In many states, for pro se litigations (people representing themselves) the final order is prepared by the court. When you file, the judge's clerk or secretary should be able to tell you what the local practice is.
