    Default Child Custody After Separation From An Alcoholic Spouse

    I have three daughters, 13, 12 and 7. Mom and I have been seperated for 6 years and she refuses to sign any papers to end the marriage.

    She is an alcholic and I have had her in rehab and child services have been involved to have her evaluated. She is moving out of state and my two older daughters do not want to live with her, they can't stand her drinking and her leaving them alone all the time so she can go out and drink. She drinks and drives with them in the car and the owners of restaurants and bars have had to drive her and the girls home because she was not able to walk, let alone drive a car.

    All of her neighbors and some family members will stand up for me and vouch the girls should live with me, and they want to. My two older daughters want to know if they are old enough to make the decision to live with me, they are willing to tell the judge they do not want to move and they do not want to live with their Mom. They know living with me is a much safer environment.

    Will the judge listen to them??

    The judge will listen to all involved parties. However a ruling will be based on what the judge feels is in the childrens best interest. By the way why is this post in an emancipation topic area?

    When children are old enough to state a meaningful preference and the parents wish, the court can listen to the children's preference and take that into consideration when determining what custody arrangement is in the children's best interest. It's not decisive.

    Why aren't you on the phone with DSS?
    Goto the courthouse, and ask the Judge for an emergency temp custody order.
    From what you are saying, those kids are in danger.
    Get them out asap.
    13, 12, and 7 shouldn't be home alone for starters.
