    Default Boss Is Trying To Intimidate Me

    I work in a child development center in texas. I have been there for about 10 months and in that time I have found out that the owner, who is also the director, has some very low morals. She said she caught me saying that she was mean which is probably true. Ever since she has tried to intimidate me by harrassing me trying to find things wrong in my room and showing up in my room all the time which she didnt used to do. She heard a rumor that another male employee and I were seeing nude pics of women and instead of asking either me or the other employee if it was true (which of course it was not) she goes and asks another employee if she had heard anything about it. This other employee she asked was not even a part of the rumor so I dont know why she would even go to her. When I confronted her about spreading rumors she said she was investigating. I say she was spreading rumors. She has said other things which I am sure go against employment laws and wanted to ask what I could do about it. The things she has done are as follows.

    racist comments: I heard her say whites and mexicans are lazy. I am of mexican descent. Besides me there is another witness who is neither white nor mexican
    illegal audio recording: thats how she says she caught me saying that she was mean. Isn't it a crime to audio record someone when they are not a part of the conversation? Can I file criminal charges against her for this? I have a witness for this as well. she admitted to it and the assistant director heard her.
    slander: spreading rummors about me and the other worker as to seeing pics of undressed girls. to be Honest he did show me some pics of his ex-coworkers but they were dressed in a unfirom sort of resembling that of the hooters girls but they were on his cellphone and only we saw them during our lunch hour. She has also spoken bad of other workers most of which no longer work there. She has talked about these workers even though I never even knew some of them. Most were gone before I ever got a job there.
    Breach of Confidentiality: She had hired 2 workers without waiting for the background checks. They worked there for about a week until the background checks came back and showed that they had a criminal background. One of them incliuded assault and drugs. The reason I know is becasue she told me. I also know she told at least one other person even though this person never even knew this 2 workers since she was hired much later and long after the 2 workers had been dismissed. Isnt this a breach of confidentiality laws? Isnt it also against licensing rules governing daycare centers to emply someone before their background checks come back?
    All of this has happend in the past few months. Starting around February 2007.

    Hope you can help me.

    Your boss can investigate a report of wrongdoing, even if the report is false.

    If you believe you are being harassed because of your ethnicity, consult a plaintiff-side employment lawyer.

    Gosh, Im new to this site, and I was looking for information on confidentiality laws and I found that answer to be incredibly void of any detail... She asked specific legality issues regardiing hiring before doing background checks, and that question was completely disregarded, as well. I hope my questions yield better responses than that.

    I agree that's a tacky thing to say. How have you been treated worse than other non-Hispanics, though, because of it? And have you reported such statements up the line and/or to HR?

    She can investigate rumors by asking with your and by asking others. Doesn't matter that the other employee wasn't "part of the rumor". There are no laws mandating how investigations are conducted.

    I do not know the answer about audio recording people who are not part of the conversation; someone else will know, hopefully.

    Child care is not my industry, but I'm assuming that this would be a violation of hiring requirements when working with children. You can report this to the government agency that licenses child care facilities.

    Telling you about the new hires and the situation involving them is not an illegal breach of "confidentiality". Except for certain medical information (and not always even then), there is very little legal expectation of "privacy" in the work arena. She could have legally taken out a billbaord on the Interstate with the same information she told you.
