Two years ago when my son was 18 he got my pin # from checking/savings acct as well as my Visa card. On a nightly basis for about 3 weeks, he would take my cards and withdraw cash advances. It wasn't until checks started bouncing and I received statements did I know this was going on.
All in all it was over $5000.00 in that short time. My son admitted it to me and said he had a cocaine problem. He agreed to make monthly pymts and give me his IRS refund until paid off.
He has since then been clean of cocaine for almost two years.
He stopped making pymts to me, telling me he could not afford it anymore. He moved up to Ct where we are originally from and has a job.
He inherited money from his grandmother when he is to turn 21...which is in Sept. he is totally aware of this but has not said he will pay me the $4000.00 he still owes me.
Can I go about it legally? I never pressed charges here in FL as he was on probation for trespassing and I feared a term in jail. I just couldn't do it.
I have recently sent him a letter telling him I expect the $4000.00 off the top as he owes that to me. He has not responded.
If he chooses to avoid this debt, what route should I take?
