    Default Shoplifted from Target

    Okay so I shoplifted from Target. I'm 18 years old, and 7 months pregnant with twins. I was with my friend, and I was looking at a baby name book. I really wanted it, but had no money. My friend kept telling me to just take it, she does it all the time, and told me I wouldn't get caught. It was the stupidest decision EVER, but I did it, and I feel retarded. We got caught, went through all the store procedures, etc. The cops were called. I got a citation, and a court date.
    Okay so I went to court last Monday. This was my first time ever doing this, so I didn't know what to do, and didn't even know what a Public Defender was. I pleaded 'guilty' because my friend did, I didn't know any better. Now I'm sentenced to 2 days in jail, $480 in fines, 2 years probation, and I'm banned from Target. (even though I called Target, apologized, and they said I'm welcome back.)
    My boyfriend's aunt works at the court, and told me to withdraw my plead, and try again, but with a PD. So I wrote a letter, explaining that i wanted to withdraw it. They told me I'd get a letter next week with the judge's response.
    Do you think they'll let me re-do this, even though I've already pleaded guilty?? I think the jail sentence was a little harsh, seeing as though this is a first time offense, the book valued only $26, and I'm pregnant. I'm actually on doctor-ordered bedrest, because I keep going into pre-term labor. I'm supposed to check myself into jail on the 21st I'm soooo scared, and this is by far the stupidest thing I've ever done. Also, I have no way to pay the fines, I'm not allowed to work, bacause of my high-risk pregnancy
    What do you all think will happen? I live in California by the way...
    Do you think they'll lessen my sentence?
    Also, I've read about Diversion programs posted on here, what exactly is that??

    I would say its very unlikely they will allow you to withdraw your plea. However you have nothing to lose at this point.

    Try and appeal the verdict? With you pleading guilty that might be hard. Just keep petitioning the courts so appeal/withdraw your plea.

    Generally when you make a plea the judge asks if if you understand the consequeces of your plea. that is generally follwed by defendant with "yes" I doubt your cas eis any different. The DA can and will likely fight the appeal. He will use minutes of orignal case and what I just posted as his reason for objecting. If that is case he will likely prevail. Unless you can provide new evidence I would guess your sunk.
