    Default Notice For Step-Parent Adoption When You Can't Find The Biological Father

    Is there a check list or conclusive how to that will instruct me on completing a step parent adoption when you have been unsuccessful in contacting the biological father? I have found step parent and biological parent termination papers but I am unsure how to proceed without signed termination papers. Are there separate forms that I need so that they will post a legal notice? We live in Texas. We want to do the adoption ourselves. We have found lots of reference to public notices etc but have not found a clear plan of execution.

    Check with your Family court to make what is proper means to notify bio Dad. It may be as simple as running an ad for several weeks in a local paper. It varies so chjeck with court first on what is acceptable means or consult a Family Law Attorney in your area

    Who would be the best person to talk to when I call Family Court? Would you call the District Clerk office that works with family court or someone else?

    Call clerk or if they have a facsilitator on staff that person. You could also try a Family Law Attorney

    Typically, after filing the case, you would go before the judge to explain why the biological father cannot be located and served, and then the judge would authorize "substituted service" meant to make it sufficiently likely that he would have notice of the proceeding. The exact nature of the service can be different depending on the facts of the situation.

    Okay, so you file the termination/adoption papers do the background check and social study then set a court date. At that time you show or explain to the judge your effort to conact bio-father at last known address etc and then the judge orders a "substituted service" (I am guessing that is a notice in the local paper of his last known address) and we wait for that to take place and then set another court date?

    Could we cut time by running a notice ourselves?
