    Default Ignored Civil Demand Letter

    My friend was caught shoplifting a movie worth 25$ from Zellers and was let go with no police involved but a few weeks later he got a civil demand letter from Zellers demanding $400. He ignored this letter and didn't pay the fine, it has now been over 6 months since he got the letter and Zellers has done nothing and he hasn't received anything from Zellers since. So if you get these letters from companies after you have been caught for shoplifting you should just ignore them because it is very very rare they will actually take you to court.

    What a merchant is likely to do will vary by (a) the merchant's policies, and (b) the laws of the jurisdiction where the shoplifting incident occurred.

    You previously indicated that you're in Canada. Virtually everybody who participates in this forum is in the United States - a different country with different laws.

    To extrapolate to the entire world from one example is not much different from saying, "I went outside the other day and got hit by lightning, so nobody should go outside any more because you'll also get hit." The sample size is too small to support the conclusion.

    Well 'm just saying you shouldn't get scared and fork over like 400 bucks right away, you should wait it out and see if they follow up with it which they probably won't.

    Civil Demand is seved (normally) by Civil Recovery services and Law Firms. both get paid based on the recovery. Since the law is on their side law suits are not troublesome nor do they require much work. If you have read through the forums here you will see several people have posted of fines tripling when they failed to pay. The law (here in US) allows law suit which could result in wage granishments liens etc. Not to mention a poor credit report. Advising someone to not pay is foolish and risky.

    This is why I like this forum, there are plenty of smart and educated people here.

    I had a similar situation. My lawyer said not to pay them because they are not going to sue you over an amount so small. He didn't say anything about the fines tripling. By the way my case was dismissed.

    Your criminal case was dismissed or your Civil Demand case was dismissed? Even without a criminal conviction retailer can still seek and win Civil Demand
