    Default Discharged Item On Credit Report After Bankruptcy

    I really did not know where else to put this question so I placed it here.
    I filed BK 8 years ago. I have a few issues.
    There has been a repo on my credit. I found out it was for a loan that I took a long time ago. That loan was put on my BK and discharged. Afterwords the bank put a repo on my credit. When I found this out a couple years back I disputed it and the credit agencies reported, "We have investigated your dispute and have determined that the item in question does belong to you and will not be removed." I never disputed that the loan belonged to me, just that it was included in a bankruptcy and the bank had every notification and chance to dispute the item at my BK hearing. They never showed. If I remember correctly this type of entry on a credit report is only allowed to be on a report for 7 years? Even if it is not settled. I cannot settle it anyway, and refuse to pay the bank for something that was discharged in a BK. Why would a person go through a BK if the bank can just make you pay anyway?

    You had a car loan. There was a Chapter 7 Bankruptcy. You either decided at that time to surrender the car, or you kept the car and continued to be responsible for the loan. Which happened?

    Neither happened. It was a personal loan to pay off bills. One of which was for an engagement ring. The girl got the ring and split. Later when I filed for the BK I included the personal loan. The repo does not say what it is, I only assume that the bank used the ring as colateral. I am not sure. I no longer have the ring either, as I said the girl took it and ran.
    During the BK hearing I was asked if I had any jewelry of value and I honestly answered no. There was only one creditor that appeared at the hearing and that was the bank for my auto loan, which I did keep. I had to sign an aggreement that the auto loan was not part of the BK and that I intended to pay off the loan. Which I did about a year and a half later.
    I was told that the item on my credit required me to contact the bank and arrange a settlement payment. As I said before, this loan was included in my BK and was discharged. If a court declared the loan discharged, why would I have to pay it back? If that is true what is the point of the court discharge? For that matter what is to stop any bank or lender from putting something on your credit that will make you pay for a discharge years later?

    You stated that the entry is for a repo. What was repossessed?

    Nothing was reposessed. No one ever contacted me about reposessing anything. I only found out that this item was on my credit last year. So I went through the appeal process through the credit agencies. One fixed the credit report, the other refused stating, "THE ITEM DOES BELONG TO YOU." Of course it belongs to me, but it was in a BK discharge.
    As I said the bank put this on my credit 1 year after the BK. As of February of this year it has been 7 years since the item was placed on my credit and 8 years since my BK. I just want this thing off my credit.
    I have done everything I can to repair my credit. I have never faulted, or been late on any payments. The BK was not even my fault, it was due to an ex-wife who stole thousands from me and put me into a position that I could not get out of. No I have a new life, one that is financially secure, but I still have this nightmare on my credit report.

    If you don't know why a repo is on your credit report, and deny that anything was ever repossessed, you're not giving us anything to work with. If you think there was an FDCPA violation, consider filing a lawsuit.
