    Default Ending A Co-Tenancy Based On A Verbal Agreement

    Greetings! I am in serious need of help.

    I reside in an amazing downtown loft in Missouri. My friend and I were going to move in and be co-tenants, and then a third party came along and wanted to join. We didn't know him well, so we had a formal meeting in which we set a verbal contract -- one that all co-tenants must follow if they are to remain living there. He agreed, as did we, and so we allowed him to be a co-tenant with us on the lease.

    The third party now cares very little for rules or respect. He doesn't clean up after himself, per the rules, and now there is quite a nasty infestation of bugs invading the house. He currently doesn't have money to pay his part of the utilities to the landlord, and our landlord supports whatever decision we make regarding the third party.

    The third party has been given a written statement, making it clear that he needs to follow the rules he verbally tied himself to, or that someone else will gladly take his place.

    We already have a responsible candidate for a replacement lined up and ready to move in.

    Question: How do we, the two responsible roommates, go about this? What do we have to do? He is breaking a verbal contract... we just need to do this legally. It has to happen.

    If he's your tenant (rent paid through you, not through your landlord), you would provide him with notice that you are ending his tenancy as described in Missouri Statute 441.060 and, if he doesn't move, commence an eviction action. Check with your landlord, or at the county courthouse, to see if there are official "notice to quit" forms you can use.
