Default Mother Is Preventing Father From Visiting His Children

My brother in law has two children 3, 1 years old. He is separated from his wife. What he can do if she doesn't allowe him to visit his children? They had not been with a judge. If she doesn't have the complete custody of the children, she can do this?

Default Re: two month without visit his children

They need to get legally divorced, if not at least legally separated, with a temporary visitation order.
By not having things in writing, from a court, it's real easy to use the kids as bargaining chips, and to put them in the middle, which is appalling to say the least.
If it's money that is the problem ( neither one has money for a lawyer ), then they can both go in, without a lawyer, and let a mediator handle it.
At the very minimum, a temporary visitation order can be drawn up so the kids don't suffer.
