    Post DWI vs Careless Driving in Minnesota

    I was pulled over on July 4th at 2:00am for speeding. I felt sober & do NOT drive if I feel like I am not (we usually take taxis). I passed (as far as I know) the field sobriety tests. I then was arrested (after blowing the initial breathlizer- don't know what I blew). I was quite upset & crying pretty hysterically. Once at the station I blew a .08 on the machine there. The officer gave me a 4th degree DWI (first offense) and told me to call the City Attorney (he even gave me his name) and tell him that I should be charged with Careless driving & that he would tell the city atty that I cooperated. I talked to the City Atty & agreed that he would plea the charges down, but said I would lose my license for 90 days instead of 30 days if I pleaded guilty to the DWI. I am very confused. I do not know what I should do. I have several questions.

    1) What are the differences for DWI vs. Careless Driving in MN? Insurance costs? Fines? Driving Revocation?

    2) What countries do not allow you to travel there if you have DWI charge? I have heard Canada does not? I travel frequently for work. If you have careless driving- does it say alcohol related on your record?

    3) How do you get this removed from your record? Does it stay forever?

    I realize now that I did screw up & should have not risked it-- never in a million years would I have guessed that I would have blown over .08, but I did & now I am stuck. Please help! Thanks in advance for your insights!

    Careless driving is a misdemeanor, but less serious than a DWI. You can ask your insurance agent how much this will raise your auto insurance rates, or try some on-line applications and see the difference.

    You can check travel restrictions with other countries when you make your travel plans.

    Absent a special remedy such as expungement, criminal convictions last a lifetime.
