    Question Help With N-400, Part 10, Section D

    My husband was cited for solicitation of a sex act from an undercover cop in Illinois back in 2001. He was only given a ticket(not arrested) and told to show in court. He admitted guilt and was given 6 months court supervision and a fine with supervision not to be monitored by a probation officer. He is now applying for citizenship and I am not sure how to answer questions 19 and 20 in section D and does Question 22 b. only apply to people who are prostitutes and pimps who seek out women to work as prostitutes or does my husband have to answer yes on this question as well for his conviction?

    (F) Prostitution. Per section 101(f)(3) of the Act and 8 CFR 316.10(b)(2)(vii), an applicant who has been involved with prostitution or commercialized vice as described in section 212(a)(2)(D) of the Act is precluded from establishing good moral character. Solicitation of a prostitute is not the same as procurement for purposes of prostitution as used in section 101(f)(3) of the Act. See Chapter 74.2(g) question 12 part (D) for additional discussion of prostitution.
    You say that he was convicted, not that he was given a deferment or suspended sentence, in which case it would appear in relation to this offense that his answer is YES to 18 and NO to 19 and 20.

    Thanks "Mr. Knowitall" for your help it allowed me to finish his application.

    Does anyone know if this will prevent him from being accepted for citizenship? He has no other criminal records.

    He will probably squeak through, but any criminal activity can put your immigration status in jeopardy.
