    Default Independent 16-Year-Old In Texas

    Well I'm 16 years old, and like everyone else I want to move out of my parents house. I live with my mom and step-father and their two children in a three bedroom house. My step-dad and I havn't gotten along in over 3 years. I used to live with my grandparents until he and my mother got married, I want to move back in with them but don't want to stress the hassal on them of a 16 year old teenager in their retirement years. When I was 13, I got my first real job working at a church's chicken. I worked there for 3 years. The summer when I was 15 I worked a total of 3 jobs, yes at my age I found ways to where it was possible, I'm determined and standing my ground. Now I'm 16, and this summer I yet again have three jobs. I know at 17 I can move out and it's only 4 months away, but me and my know-it-all step-father have been continously argueing since the beggining of the year. YES, I pay my truck payments, insurance, cell phone, personal needs (clothes, school supplies, etc.) I PAY MY OWN GAS, which most kids don't and I know hands on, living on my own is not going to be no party. Well since I'm still under the legal age, he has pretty much said that I can figure out how to pay my own bills with out an adult (My mom and him signing off on everything) and has canceled everything. My truck however my grandparents bought from him for me, and I've been paying them monthly. WELL he took that too saying the title was still in his name, I can't get proof cause funny how it is, my grandparents are gone for the next three weeks on a motorcycle. So the only people that stand up for me are gone, and funny how he starts drama right when they leave. I know once they come back I can have all my insurance and everything figured out again through them, their just the ones I have always been able to count on. I've offered to pay rent, I've asked to move out and he says no, just to make my life just 'Oh soo much better and it seems like my mom is afraid to stand up for me. I've been paying my own way since I was 13. I'm determined and my one goal in life is too proove to him I'm not trash like he thinks I am. Im an honor roll student, this is my senior year. I graduate a year early from high school on a "over-achievers" program and I'm also taking dual credit courses at St. Phillip's University this year as well. Even though I work 3 jobs this summer, I also do community service with disabled children, and I'm taking online courses for school. I don't know what else I need legally just to live on my own, and I want this more than anything. I've already looked into roomates and the cost of living in apartments here in san antonio and I know I can make it on my own. Help would be greatly appreciated please, thanks for reading.

    To emancipate in Texas at 16, the statute requires that you be living independently of your parents. (A minor may petition to have the disabilities of minority removed for limited or general purposes if the minor is ... 17 years of age, or at least 16 years of age and living separate and apart from the minor's parents, managing conservator, or guardian....)

    With your parents' permission. You can move out at 16 if your parents agree to it. You don't need your step-father's permission unless he adopted you. You would need your mother and legal father's permission.

    well i live with my aunt who has guardianship but my dad gave her permission to have custody of us could he give me permission

    Not if your aunt has custody. You would need her permission.

    She has a guardianship and custody because a court granted her guardianship and custody?

    Okay, So my step dad already moved to colorado and my mother is leaving within a month. I want to stay here in Texas, I have worked extremely hard and am taking online courses here in Texas to graduate a year early from school which I also have paid $600 dollars to be able to do so (graduate this year). I'm also taking dual credit courses through a local college. If I were to move to Colorado all of my hardwork would go down the drain because there are less class periods there then here and Texas' laws for graduating early indicate you can only take 2 extra courses to graduate early, which I'm doing now. So I will lose a credit and have to be In school for one more year and only have to take 1 more class (and that's to graduate still with 1 1/2 more credits then needed) I have a place to stay and I have two jobs that I have been at for a long time and I make good money. I have my own transportation which I paid for and I also pay my insurance for my veihcle. I take care of all my needs and pay for everything I need or want. I don't really have time to mess with the emancipation nor the extra money if I plan on trying to live on my own. (Does anyone know how much that does cost?) I DO however are on Deffered Judisfication (if I spelled that right) until April 4, 2008 (I was at the wrong place at the wrong time) Other then that incident I have had no other tickets, complaints, or anything else involving that stuff. I want to stay here in Texas and I turn 17 this month. My mom said I can stay but she's the type to say I can stay then call the cops and report me as a "runnaway" so I was just wondering if there was any way I could get that on paper, or if there's paper's for her to sign, OR if I should type my own paper and have her sign it infront of a notary? I have gotten permission from my district to stay I just need the more technical aspect of this situation.
