hi, I am hoping someone here can shed some light with our situation. My husband was arrested 12/05 for public assistance fraud,stemming back from 2001. He was placed on probation in May 2006. Anyways, he has had a heart attack 11/05 and has a severe heart condition where he needs a transplant in the very near future.He doesnt work @ this time and is on SSD. Anyways, he is on probation and all of that for 2 yrs, if he violates, 5 years! Everything was going fine till April 07.Our officer was not in the building in March, but we checked in and saw someone else who said the PO will call you with next months date.Well, yeah, she called, cussing him out and stated he better be in her office in the next hr or he is violating.We explained what the lady said last month, and in all honesty, I shouldnt have trusted this person, I should of called and scheduled his time (and I was thinking about it that am)yes, we are responsible for our own times..anyways, the PO was fuming mad when he showed up and she had him do a urine drug test(he has done about 4 of them in 10 mths)She has a current list of his meds on file as well...anyways, he tested positive for opiates, which we knew he would because he took a pain pill for a migrane the night before.She wanted another list of meds, I told her I will go right to his Dr and get it.I brought it back to her and our Drs office faxed it .No big deal as he has a script and hardly takes them.... In the meatime, the PO was yelling at her husband on the phone with him sitting there..so, she was upset as it was.So, when we check back with her in May,the place was crowded and she didnt take us to her office but a side room. She asks, everything ok? He states yes, no problems."Our family will like to go out of state for 10 days" she said, "ok, just give me the info on where you will be and it shouldn't be a problem. She then proceeds to say, "we are arresting everyone today for violations with a smile on her face. She then came by that night to our house and forgot to take the info, so I dropped it off at her office the next day. So, she has seem my husband numerous times before we left for our trip.We went out of state, our family who we were visiting were never called by the PO, nothing..We get back and a few days later, they ARREST my husband for violation of probation for a positive drug test. I asked, what? she said that urine came back positive for hydrocodone(he has a script) AND hydromorphone! she then tells me hes prob. using without my knowledge! This man takes 12 heart meds a day, and will hardly take a Tylenol.Plus, drugs would kill him thats for sure. Anyways, they arrested him, and the jail nurse wouldnt take him in cause his b/p was so high, so he goes to the hosp.they get him b/p down, took several hrs but it went down, then returned him to jail.I later found out he was sleeping on the floor in the medical area.Anyways, we go to first appearnance, and the public defender supervisor was on hand for us, (we have to use a public defender, no choice)I handed her all of the paperwork showing my husbands illness related info and that I am his caretaker.The states Attorney didnt want to let him out on bond.Due to his charges turning into "Grand Theft" from the public assistance fraud, cause of the statutes of Limitations.The SA and others considered him a "flight risk" We own our home with 2 kids etc. I brought up the fact that we went out of state, had permission and the drug test in question was from 2 months ago.I also gave them his script and the SA stated, "hydromorphone showed up".I told them I will make bail...they said they have to think about it and go thru his medical history etc.A few hrs later, I get the call that he can be bonded out $1,500. 150 to a bail bondsman.So, I went and took care of that, he got out that night. In the meantime, I have alot of info. on how hydrocodone can "morph" into Hydromorphone. I have documentation from good sources, Dr and a pharmacist etc.saying different peoples liver metabolizes things differently. In the meantime, we receive paperwork from a public defender who will be seeing his case and that courtdate is set up for next week, etc...and the paper says to call right away to discuss the case.So, he calls right away.This was 2.5 weeks ago.No one is returning our calls, and we made several. So, we are planning on visiting the public defenders office tomorrow to see whats going on. I have also tried to contact the supervisor of the office and the person answering the phone hasnt put me thru, or give my messages.anyways, we also received all of the facts leading up to the arrest, and come to find out, our Probation officer knew before we went on our trip the drug test showing the Morphone..and also put a warrant out for him in May!!! When we saw her in May, she had all of this info! Thinking about it scares the crap outta me, like what would of happened if he was pulled over while we were out of state.I cant believe she let him go with all of this knowledge!
so, his Plea is next week, does anyone have any advice on how to handle this? So sorry for the length of this, but I wanted all of the info to be here.
