    Default Fired Because Of Sexual Harrasment

    A very close friend of mine was recently fired for sexual harassment. He claims that he did not do anything remotely close to sexual harassment and I believe him. I've known him for 26 years (since we were toddlers) and I just could not see him doing something like that. He is very respectful towards women, so respectful that he would not even set foot in a strip club!

    I asked him about details and he was just as clueless as I am. He tried talking to his manager but his manager won't give him any details other than a woman in his workplace complained.

    What can I do to help my friend?

    He should have been given some explanation as to what he did and given a chance to defend himself. Unless of course there was some documentation or evidence to prove the claim. Example email etc. Now he could complain to DOD but that will take some time to resolve if at all. Sexual harassment is tough and almost anything can qualify. He could hire an Attorney and pay him tons of cash with no results and if any it will take quite some time maybe years! Tell him to again ask what was the offense. Not tha tit will change anything but in case it was something he did do intentional or not so he can correct it. Then tell him to seek new employment and avoid mentioning sexual harassment in any interview.

    If he's at-will, as most employees are, he can be fired for suspicion of sexual harassment. He may have recourse if his employer had policies for handling and investigating reports of sexual harassment, and they weren't followed.

    If he's a union member or has an employment contract limiting the reasons he can be fired, he may also have recourse.

    Yes, he was an at-will employee. I don't know anything about his workplace's policies.

    It just seems to unfair...he is one of the nicest guys anyone will ever meet.

    If anyone should be accused of sexual harassment, it should be me. I've gotten away with a lot of stuff at my work but most women seemed to actually like it. Instead of being offended by my lewd comments or touching, they often flirt back with their own comments and/or touching.

    Think of it this way: People like you have created the context where people like your friend get fired on suspicion of sexual harassment.

    There not only is no law requiring that he be provided with details, depending on the specific nature of the complaint, to do so might be unwise.

    There is NOTHING that you can do to help your friend. You have no standing to interfere in his employment relationship. As Aaron points out, you can thank yourself for creating the context where someone is getting fired for suspicion of SH. I assure you that at least half of the women who "appear" to like your comments are going along with it because they are afraid to do otherwise and are not brave enough to report you.

    I will go tell him to ask his manager again. My friend is just very confused right now and doesn't know what he did wrong. He has a good heart and is a very nice guy, maybe too nice for his own good.

    Is it required by law to give the accused some details of the harassment complaint?
