    Default Instructed Not To Perform Magic Tricks At A Government Office

    This year in Michigan I was at the Secretary of State to get my license plate renewed (Motor Vehicles Department in other states). I was sitting down waiting for my number to be called. I was showing magic tricks to other adults while they are wainting too, it makes times go quicker. A staff worker left the counter to approach me. She told me to stop showing my magic tricks. She never told me why she wanted me to stop. I was stunned and stopped my magic tricks.

    The Secretary of State is a public area. Does performing magic tricks fall under the First Amendent? Would I of had the right to continue to perform?

    No one was complaining of my entertainment. Maybe the staff told me to stop because of her religion. Some religions are against magic tricks.

    You don't have an unbridled right of "free expression" just because you're inside a government office. The office is entitled to impose reasonable time, place and manner restrictions on speech and expressive conduct. (I'm not sure how much expressive conduct there is in the performance of a magic trick, but that's another issue.)

    The only reason I would see they had a reason to stop you was that you were causing some sort of problem.

    If so, they did have the right to stop you.
