    Unhappy Early Lease Termination Fees For Apartment That Is Being Renovated

    I have an early termination two month before the lease expire. We inform the landlord one month before we move out. The landlord did not inform us we can do a move out walk through. After we move out, the landlord carry renovation of the apartment for that two month instead of leasing it out as soon as possible.

    My question are :

    1. What is my legal ground for not responsible for that two months of rent?

    2. The landlord also charging me for cost of repairing and cleaning of the apartment. What is my legal ground for not responsible for this charges?

    Your lease requires two months payment for early termination? I doubt, then, that there are options to avoid that.

    In terms of damage you caused, why wouldn't you be responsible for repairs?

    The lease is a year lease but we moved out on the tenth month. Therefore we are responsible for the two month rent or until the apartment is re-rented. However, I believe the landlord should also try to re-rent the place as soon as possible. However, he try to take advantage of the situation and make large amount of renovation during this two month. Besides, we keep the place very clean and did no damange to the apartment. The apartment should be ready to be re-rented after general cleaning, which mean at most one week is required. My understanding of the law is that the landlord should try to re-rent the place and mitigate the demage on the tenant. I am not sure if what the landlord did is against the law in the sense that I am not responsible to pay the rent for him to do renovation.

    Again, we did no damange to the apartment. But the landlord just come up with some fake item for repair and charge us. Meanwhile, he has no prove ,such as photos, that those damage ever exists. Therefore, I believe that we should get our deposit back without any deduction

    If you had a one year lease and you moved out at the tenth month I can see why your landlord would want the other two months as payment, but at that point your lease would be up.

    I mean, I don't see any way that the landlord could charge you for time beyond what your lease required you to stay.

    I am NOT a lawyer or anything, I am just throwing in my two cents.
