    Default Suing DHS

    Lately, I have been very frustrated with the way our government is working. I have been a victim of marriage fraud and it appears no one in our government gives a damn. These fraudsters come to our country and then extort money out of innocent American citizens. They have found a new legal way to extort the money which is affidavit of support. Once you sign that support you are basically screwed. They have all the power in their hand to do anything and everything.

    Once you inform the USCIS and DHS about this fraud and they assure you that they will deport the alien, can you sue them if that alien files a law suit against you for affidavit of support?

    I would assume yes because anyone can file law suit in America. I guess this will bring USCIS's attention.

    As you note, you can sue whomever you want, but if you do so you're likely to run squarely into a wall by the name of "governmental immunity".

    That is exactly what my lawyer said that Government has immunity and you cannot do anything. Then what is the legal recourse available to citizens who are completely screwed because it is the government who forced us to sign the document. It is a catch 22 situation. If you don't sign the support then the alien you are trying to sponsor does not get a greencard, if you sign the support and then alien say Adios I married you for the greencard only and now you STUPID pay me the support because your only mistake was you truly loved me. Then what do we do, just sit back and say yes honey I will pay you $10k, $20k every year until you decide you want to become a US citizen because that is when I can get out of this support.

    I believe that the obligation is only for the first 5 years. That being said, that is enough time to bankrupt most of us. Double check, it may be an expensive lesson, but not a lifetime commitment

    It is so hard to prove fraud. Yet DHS has heard plenty of complaints from citizens. All these people cannot be making this up. What do you recommend victims of immigration fraud do?
