    Default Civil Demand After A Friend Was Caught Shoplifting

    I was with my friend who shoplifted from Kohl's and was prosecuted, I did nothing and was not aware of what was going on and the cops told me I was fine and free to go, but I still had to sign an agreement to not go back to that store which I did. One month later I get a letter in the mail from Kohl's saying "you took merchandise from Kohl's without paying" and "you owe $225" I called the number the letter told me to call and I explained that I had never stolen from kohl's and the lady said I still had to pay the civil relief. Can they do this even though the cops said I did nothing wrong? I'm about to call my lawyer and sue them for harrassment and deprivation of character, is any of this possible?

    The store sent the Civil Demanf request. Either by mistake or on purpose because they felt or have evidence you had knowledge of theft. You can of course hire an Attorney and pay him/her $1000.00 to save $200.00 or you can contact store Manager and see what he/she can do such as contact Civil Recvoery service or law Firm and remove request.

    Thanks, I will contact the store manager. I rather spend all the money I need to to fight for something I know i'm not guilty of.

    The only way the Civil Demand request could have came to them is if Loss Prevention named you as an accomplance. This could have been an error. Often times when stopping alifter who is with another both are brought and one released if not involved. Thsi may have happened here but your name and address still went on report. Fact pD even let you saying you were not involved will help. Go to Store manager and if not happy with result got to corporate. If you were released as "not involved" in theft then no Civil Demand request should have been issued. This is far easier and cheaper than hiring an Attorney with no gurantee of victory.
