    Post 17 Year Old In Louisiana

    Alright, My name is David, and im 17 years old. Right now, I currently live with my mom and grandma in Shreveport, Louisiana. The people I live with, I dont get along with all the time. Im arguing with someone in this house everyday, if not, every other day. Im sick of living here. I wasnt going to move out till I turned 18 which would be Dec.4 of this year (about 6 months from now). Well for the last three days now, me and my mom have been arguing constantly about the fact of me moving out when I turn 18. Well shes already told me, that when I move out shes soing to take away my vehicle and cell phone. Which I have completely come to accept. I already knew something like this was going to happen between me and her. Well my truck went into the shop yesterday and its gonna cost $4000 to get it fixed (just a bunch of engine problems). Anyhow, she said shes just not going to get it fixed sine I only have six months left till im 18 and wanting to move out. Well down to my point now, I want to empancipate before school starts. This would be my senior year coming up. Im thinking if im going to move out, its better for me to move before school starts instead moving half way through it. I have been workin with Kroger as a cashier for a year and a month now. I work full time in the summer, and during the school year I work part time. Thats how Ive been working with them. I make $5.51 an hour and the minmum wage pay is suppose to go up this upcoming month in Louisiana to $6.25-$7.25 because of the new minimum wage bill we have in Louisiana which was recently approved. So, I would be making more than I am now. If I get emancipated, I already have a place to live offered by my friends that I helped them move into a month ago. They are willing to let me live with them as long as I help them pay bills with my job. Two of them are soon to have vehicles, and I know 3 more people willing to help me get to school and work and back to where I would be living. So what all needs to be done so that I can be emancipated before school starts if possible? (School for me starts the the first week of August).

    Louisiana recognizes three types of emancipation:

    1. Emancipation conferring the power of administration.

    2. Emancipation by marriage.

    3. Emancipation relieving the minor from the time prescribed by law for attaining the age of majority.

    Some statutes from the Louisiana Civil Code describing how emancipation can be obtained:

    Quoting Art. 366. Emancipation by notarial act

    The minor, although not married, may be emancipated by his father or, upon the death of the father, by his mother or, in the event of divorce or separation from bed and board, by the natural tutor or cotutors acting jointly, when he shall have arrived at the full age of fifteen years.

    This emancipation takes place by the declaration to that effect of the father, the mother, or both, before a notary public in the presence of two witnesses.

    Quoting Art. 368. Emancipation by reason of ill treatment.

    The minor may be emancipated against the will of his father and mother, when they ill treat him excessively, refuse him support, or give him corrupt examples.

    The minor who is emancipated has the full administration of his estate, and may pass all acts which are confined to such administration, grant leases, receive his revenues and moneys which may be due to him, and give receipts for the same.

    The minor, whether male or female, is emancipated of right by marriage.

    Quoting Art. 385. Emancipation of minor sixteen years or older.

    A minor sixteen years of age or older may be judicially emancipated and relieved of the disabilities which attach to minority as provided in Articles 3991 through 3994 of the Louisiana Code of Civil Procedure.
