I let exboyfriend stay temporarily stay in my apt (has never paid any rent) when he moved down to Oceanside from San Jose a year ago until he got on his feet. He has never had a key to the apartment nor is he on the lease (landlord does not know he is here - as we are to report any guests, etc...and have them added to lease, etc...) I have had it with him not working, not paying rent, and have told him he has to leave. He refuses, saying he has "established residency", and because he has some of his stuff in my apartment and in my garage. He says if I toss his stuff out he will call the police and have me arrested. I am afraid as he has once again turned violent - after 6 years of no violence - (I had a restraining order in San Jose - which was not transferred down here, and has since expired ). Yet, when I did call the police here in Oceanside once, they said I could be arrested for having contact w/him since I once filed a restraining order???

How can I get him out? Will a 3 day notice work, or will it take 30 days? He has jimmied all the locks on my doors now and enters my apt and garage (he rigged garage door where no longer works - had landlord fix once, but he's done it again). When he first started staying here, I made him go out and job-hunt everyday - and I would let him in when I got off work, so he's never had a key, but now enters whenever he wants (have replace locks 3 times) and he now has bent "wrought iron exterior front door security screen lock" so he can open that, then the front door and enter whenever he wants.

Pls, need advise ASAP!
