    Default Son Sleeping In The Garage?

    Hello,

    Let me first state that we live in Oregon. My husband's son has asked to come live with his dad. He is 15 years old. He currently resides with his mother. She does not have a problem with this. She is willing to give custody to my husband. Anyway, the problem is that we live in a two bedroom house. In that house is my husbands 13 year old daughter, myself, and my husband. Anyway, I do not think it would be legal or morally right to have a 15 year old boy share a room with his 13 old sister. Is that legal? So our next option is to fix up the attached garage into a bedroom. It is a finished garge with heat. We could make the room look nice with photos on the walls, a nice bedroom, lay throw rugs on the floor. But would this be legal??? It is attached to the house and also has an outside exit door. The big problem is also that we rent the house. Can our landlord discriminate if we use the finished garage as a bedroom for my husband 15 year old? It is a lease and we have another year left on it. So, I guess my question is, "Is it legal for a 15 year old to sleep in a finished garage that we could fix up or would that cause child services to get upset or something?" also "Can our landlord exict us if we sleeps in the garage and is not listed on our lease?" And also " Is it legal for a boy and girl of that age to share a room in the state of Oregon?" (even though I feel it would be morally wrong, my husband still wants me to ask that last question)

    Your lease would have to provide the answer to whether the LL would allow it.

    The garage, unless legally converted to "living quarters" will probably not be legally available to be used as living quarters. That alone may give the LL, or the local municipal authority, reason to give you grief about the situation.

    Your lease would also need to be consulted as to whether an additional tenant would be aceptable at all.

    as far as the two kids in the same room? Not really sure but in general, it would not be illegal. There are some municipalities that do restrict such a situation though. Additionallty, if you recieve any sort of state assistance, they also may have rules against such a situation.

    I beleive it would not be advisable though. A 15 yo boy is just really starting to get his hormones rolling and may not be a good choice to room with a 13 yo female. Not trying to infer anything but I just suggest against placing children around these ages being given a test such as this. They each need whatever privacy that can be afforded to them. A young female is also near or into their maturation enough to really need such privacy.

    Thanks for your post. I have another question that I hope you can help me with. What if we got a fifth wheel, or a camper, and we let him have his room in that? Would that be considered legal for a 15 year old to room in or would child services step in over that? I really feel bad becasue his mother cannot deal with him anymore and I know that my husband wants to step and let his son finally live with him BUT we are locked into a year still in that lease and moving is NOT an option at this time. So any advice is most welcome.

    If that is even legal would have to be investigated. Both your LL and the municipality may not allow it either. I suspect neither of them would allow it.

    I honestly don't have any suggestions to help you through this. I understand the situation and applaud you and your husband for trying to take care of his son, even with the problems that seem to be the cause of all of this.

    Maybe somebody else on the forum will have something to offer.

    Do you have a basement?
    And i know that is is in fact illegal for oppisite sex siblings to share a bedroom, after a certain age, in certain states.
    But, in my line of work, I see it all the time. There's really no reason to think the
    cops will come banging down your door. It may be a rough year for those kids, sharing a bedroom, but it's only a year.
    Talk to your landlord, maybe get out of the lease early.
    Worst case scenario, give 60 day notice to your LL, and find another place.
    You will more than likely lose your security and last month deposit, but, this is better for the kids, and thats more important than breaking your lease.
    That's what i would do anyway.

    Easy solution. Buy a sleeper sofa and either let the son sleep in the living or you and the father can sleep there and give son your bedroom. Parents make this sacrifice all the time for their children. This only has to be a temporary situation until you can move to a more appropriate home.

    My cousins are an 11 year old boy and 12 year old girl. Sometime in the past year or two it became required for them to have seperate bedrooms. It's possible this was only a part of the custody agreement, but my uncle was forced to move in order for this to be possible. He does not have primary custody, but it was still a requirement for the time the children spent at his house. The boy slept on the living room couch for several months before the move took place, as far as I know this was acceptable (or I suppose it's possible authorities didn't find out...) Not an official answer, but a relevent case study nonetheless. This is in Michigan.

    It's not a law in Michigan, but it is something a court can order.
