My brother is moving back to Texas from Arizona as his employment has ended. He moved there from Texas 1 year ago and his lease expires 6-30-07. He did not, however give advance notice that he was vacating, but informed the manager in person today that he will be moving out due and scheduled a walk through for Sat morning. I don't have a copy of his lease or no how it is worded, but I learned today that, when he leased the apt last summer, they required a surety bond in addition to his security deposit. I assume this was due to his lack of previous rental history and a less than stellar credit rating (he's an archaelogist and travels quite a bit). The manager stated that he would forfeit his surety bond.
I'm not at all familiar with the use of a surety bond in this situation....I assume that it is suppose to cover their losses in the event he defaults? Last month he received notice that, if he didn't renew his lease, his rent would increase $200/mo for month-to-month extension. I'm trying to calculate whether he will owe them additional rent through what would be the notice period had he given advance notice to of his intent to vacate.
