    Default Illinois Custody issue

    My son and girlfriend lived here with me. She had my grandson in early 2006. My son broke up with her about 6 months after the baby was born. I let her stay here because of the baby. She has serious depression issues that make her fly into rages.

    She left in early May this year (2007). She stayed at her mom's for a bout a week when her mom kicked her out after beating up her sister. She left my grandson with her mom. She didn't called my son or me to let us know for several days.

    It has now been a month of Austin being in her mom's house without her there and my son wants his son. There is no custody agreement yet. She has not signed it.

    Does he have the right to take his son? Does his rights supercede his exes (since she left him with her mom) and her mom's rights?

    I have an attorney on retainer but everytime I talk to him to ask a question it costs.

    I know I am new here but I hope you can help me. We really miss babyboy.

    Were they married? If not, has his paternity been established?

    They were never married. Paternity is established. I know in Illinois more and more unwed fathers are being heard in the courts. I am hoping my son will be another to add to the list.

    I should add that she is not allowed at her mom's per the landlord and her mom because of what she did to her sister. It was in front of the landlord, his wife, her mom, and the baby. She can go over to get the baby but can't stay.

    If he has established his paternity but has never sought a custody and visitation order, he needs to initiate a court action to formalize his rights.
