    Unhappy Domestic Battery and Criminal Records

    Hi,
    I had an argument with my husband and became very angry when he hit me and had to call the cops. They arrested him although by the time they came home we had settled down and compromised- the cops told me that they had to arrest him since I confirmed him hitting me and he denied. He is out on bail now- I really want this charge to be dropped- he is a good husband and a good dad of our 2 kids and although we argue a lot this is the first physical incident. when we went to the court for bail hearing the state attorney who rep me said it will be dropped within a week but the judge asked us to he in the court again next month. Will it come up in any bg checks or records ?Could you please let me know what I should do to get this dropped and also clear any records of it. We really want to sort our differences and move forward- Please advice. We live in IL

    He was arrested, so the arrest could show up. He was charged, so the charge and its disposition (even a dismissal or acquittal) could show up. How he might remove the information from his record depends on the disposition - there's a lot of information about Illinois expungement here.

    On a peripheral issue, he hit you. If it's the first time, it probably won't be the last. Domestic violence usually escalates over time, with the "honeymoon periods" when he's sweet and promises that it will never happen again becoming shorter with each new incident. If this is truly the first time he has hit you, I would suggest you consider if you really want to stay with him - and if you decide to stay you should make clear that you're out the door with the kids if it happens again. If it is not the first time, you need to start thinking about the effect on your kids.
