    Default Immigration Based Upon A Long-Term Relationship While Married

    I am a holder of a 10 year multiple visa and have lived in with my boyfriend twice on those visits I had. This year he has finally committed and intends to marry me. I am unhappily married for 5 years now and intend to file divorce in the US and later marry my bf. There is no divorce in my country so I seek to do this in the USA.

    My question is, is there a violation under USCIS on the issue of filing a divorce here and marry your bf in the US. Others are saying, we both have to prtend that we just met from the time I get my divorce approval till marriage. Which isnt true? I have known him 4 years ago and have lived with him twice. Will I have problems if I got married with him and apply for change of visa status? Should we decide to tell the truth that we have known each other for 4 years already?

    You don't have to pretend that you just met.

    I don't know what type of visa you have been using. If it is a tourist visa, getting divorced and married in the U.S. could raise the specter that you misrepresented your intentions when entering the U.S. (I don't believe that just getting divorced would raise the same questions.) I would suggest consulting an immigration lawyer with the specifics of your case, and determining if (after divorce) you should try to enter on a fiancée visa in order to marry.
