    Default Rental Security Deposit After Death

    We are in Palm Beach County Florida.

    My Mother's rented flawlessly for over 20 years. Even while away for almost 10 years she still maintained the unit. She became terminally ill two years ago. The last 10 months she's been under the care of the brilliant Palm Beach Florida Hospice folks. The last 5 months I've been with her and she passed peacefully this weekend. Since she was so ill we've been renting on a month to month basis for a few months. I have a good relationship with the property's management (this is unique!), we are wondering what is done in regards to the security deposit? Does it go to the estate (me, the son)? Are we penalized for not giving "proper notice"? We gave as much notice as possible considering the situation and will leave the place clean. Thanks for any comments.

    Any amount above and beyond rent owed (or damages charged) would go to the estate. The landlord is entitled to proper notice, and rent during the notice period, although you can see if the landlord will let you off the hook either because he likes you or because another tenant is available for the unit.
