    Default Petty Theft

    Hey I have a question. I was convicted of petty theft 8 years ago in California and they had dismissed the case and I have papers from court to prove saying they no longer have the file available in their system since its been such a long time. The problem is that I haved submitted an application for Naturalization but under the question " Have you ever been convicted of a crime?" I answered "No". I know I will be under oath at the time of interview and I know they will ask this question again. Should I tell them the truth and explain to them why I said no and have legal documents to prove that Orange County court house no longer has my record? The main reason I said no is because I thought after 8 years its considered totally gone but I'm probably wrong. Thanks and I hope to hear from you soon...

    If the case was dismissed without a conviction being entered, then technically you were not convicted even if you entered a guilty plea, and you can explain the full circumstances during your interview. That's commonly called a "deferment" or "deferred sentence".

    I was never convicted but I did pay a fine. Its one of those stupid things you do when youre a juvenile...

    Should I let them know about it before they start interviewing me or should I not saying anything unless if they ever bring it up?
    Then I can show them the proof...

    Beyond "Honesty is the best policy", if you want advice on what to do during your interview your best bet is to consult an immigration lawyer.
