    Post Design Patents And Provisional Patents

    I filed my provisional application and I waited about a month to file my design patent and a few people seen my design after I filed my provisional. If one of those individuals patented my design before I did, am I out of luck?

    I used the drawing in my provisional filling, so can I use that as evidence to prove that they stole my design? This would predate any evidence they could provide.....

    A provisional application provides you with no protection in relation to a subsequent design patent application. If somebody stole your idea, you may have other legal remedies available to you and should consult a lawyer.
