    Default Landlord Advertised Wrong School Zone - Can I Break The Lease?

    The renter advertised his Georgia property as being located in a specific school zone for my child. Upon signing a one year lease and then enrolling my child, the school district informed me the property is NOT in their zone and there are no exceptions. Since the only reason for taking his property was to get my child in that particular school, can I break the lease as I must now find a home in that zone? Renter wants to hold me on the lease even though the wrong school is advertised in writing on his ad! He claims the school was in his zone a few years ago and changed without his knowledge. Please help.

    It's a question of materiality - is the school district material to the lease? It sounds like under the circumstances, that was a "make or break" issue for you. Also, your landlord's response that "(maybe) it used to be this way" doesn't change the fact that his ad was wrong.

    If your landlord doesn't respond to reason, consider trying to get a local lawyer to send him a letter describing your rights under these circumstances to see if that helps encourage him to release you from the lease. Recall that if you don't agree, this will likely end up in court and the judge will ultimately decide who is correct. It will save a lot of time, bother, and perhaps money to reach an agreement.
