    Default Cell Phone Reported Stolen By Ex-Girlfriend

    I have a really sticky situation here. First of all, we live in Florida.
    This is an AMAZINGLY long story, but I will try and keep it to the necessary details.
    My boyfriend's ex girlfriend bought him a phone from Verizon last June. He was on her plan, but wasn't allowed to have access. They broke up in July and he kept the phone. She never said anything about wanting the phone back or anything along those lines. He stayed on her plan and payed around $100/month every month until December 2, 2006 when the phone was shut off. The reason teh service was cancelled was because we thought it was a dumb idea to take this angry psychotic ex-girlfriend's word for it that his actual part of the bill was $85. (This is with him having no text messaging and the lowest minutes available...doesn't add up quite right, does it?) So he asked her to put him on the account so that he could actually have proof of how much he was paying and to make sure that it was the right amount. Well, she didn't want to put him on the account (which looks REALLY interesting...) but said she would send a bill (which she never did). Well, we have a text from her that day that says, "let me kno whats going on. r u gonna actually pay ur bill n keep the phone or what" (verbatim). I have a picture of the text as proof. The phone was shut off after a bunch of b.s. back and forth for 6 hours, but she still had my number, so she could contact us.
    Well, my boyfriend and I have had this phone for 6 months and we aren't using it, so we figured we would sell it to get some extra cash and get rid of a bad memory. Well, she found my account on Ebay and saw that I was selling the phone. I sent the phone off and I got an e-mail today from the recipient and she said, "I received the phone today. However, when I called to activate it I was told that there was a police report out for the phone and I was unable to activate it. I need you to either figure out what's going on with the phone or I am to get my money back ASAP and the phone will be sent in the mail as soon as my money is received. Thanks."

    Now that I explained the situation, what should we even do about this? I didn't even know that this sort of thing could happen. We plan on going to Verizon and then to the police department (because his ex-girlfriend live in St. Petersburg). Will we get arrested if we go to the police department? What shoudl we do in regards to getting the police report to be lifted? We have proof that he payed part of the bill and this phone was a gift. Also, that text message specifically asks him if he's going to keep the phone. I can't believe that she's actually doing this. She just had a child as well and believe that my boyfriend is the father and instead of coming after him for child support, she comes after him for a phone?!?!? Who does this kind of stuff? I'm not concerned about the money, becuase we don't need it, but I cam concerned abotu their being a warrant or something.

    Obviously you need to refund the money to the eBay buyer and get the phone back. Beyond that you need to figure out what is going on with the police and try to straighten things out. It's tricky to do that yourself, so I would recommend hiring a criminal defense lawyer to assist you.

    Well, I am going to refund the money if I can't get this settled. But what is all of this going to entail? Are we going to need to go to court for it? I mean, seriously, we don't care about this phone. I would just as soon send it to her and get the thing out of my house than have to deal with any of this. The phone isn't worth the court and lawyer fees. I need a detailed response on what to expect if we go to Verizon and/or the police department.

    Also, how would I go about finding out what's going on with the police?
    Another question. If she knew that we had it, why would she say that it was stolen? Isn't that just going to make her look stupid? We have proof that she KNOWS where the phone was.

    You would ask the police. But they don't have to tell you about an ongoing investigation.

    Why does it matter that she knew your boyfriend has the phone? All that means is that she is accusing him of stealing it.

    So I just walk into the police station and say, "Hey I think I'm being accused of stealing, what can you tell me about it?" If I'm part of the investigation and I have the phone on my person, then I would assume they would talk to me about it. However, that's not my question. I'm just trying to get an idea as to what I can expect when I go through this process.
    We have a message that says "keep the phone" in it. Does that count for anything? I woudl assume that it does. And doesn't it look a little strange that all of sudden 6 months LATER she decides to file a police report? I think she's going to end up looking stupid in all of this, but I want to make sure that we aren't going to jail over somethign as stupid as a cell phone. I mean, hell, I would just give it back to her stupid ass. I'm not in the mood to deal with all of this crap and haven't been for the past year.
    She never asked for the phone to be returned to her or anything, so how can she say that it was stolen? I'm just trying to wrap my mind around how this is possible. Obviously she didn't give all of the details to the police, or this woudln't have happened.
