    Default False Police Report Claiming Domestic Violence

    Good Morning!
    I am confused on what the Texas law says about filing a false report.
    Let me explain. My brother and his girlfriend, share my niece together, adn she also has another boy from a previous fling. "S" is not a stable person, she is very possessive of my brother. Apparently, they got into an arguement, and hte first story told was that my brother kicked the crud out of her and broke her leg. Felony Domestic violence charges were filed against him and the state put an emergency protective order against him where he cannot go with in 500 feet of her or the kids. My brother was arrested, and apparently CPS is involved. S changed her story the very next day.She went to MS for 1 day, and then my Dad drove half way the next day to bring her back. My brother hired an attorney because he swore the accusations against him were false, and he now cannot see his daughter. Her story that she gave to his attorney and signed a statement in the atorney's presence states that what actually happened was that they got into a fight and she went and locked herself in the bathroom with a knife threatening to slice her wrists. He busted through the door and tried to get the knife from her, they struggled, and both fell, landing between the toilet and tub, and that is how she obtained a hairline fracture on the leg.
    Isnt there a law about filing false reports, and what can now happen to her and the kids for doing so?

    Retractions happen frequently in domestic violence cases. The vast majority of the time the initial allegation is true and it is the retraction that is false. Don't count on charges being filed against the girlfriend.

    With any luck, CPS will hold onto the kids until all parties get counseling. At best, she's a danger to herself or others ... at worst, he's a violent thug. If a little of both is true, God help those kids.

    This couple needs a lot of help, and those kids need to be out of there.
