    Question Support For A College-Aged Child In New York

    My youngest son is now 19 years old, just finishing his freshman college year. He has been living in his own apartment since January, and his mother has told him "once you're out, you're out". Since she is no longer providing a home for him, can I cease or reduce child support?

    Some background: My child support arrangement was put in place in 1995, at which time I agreed (as part of my New York State divorce agreement) to pay $1100 per month for 2 children until their 21st birthdays or upon graduation from a 4 year program, which ever is later. That amount has never been revisited, and even though my oldest is now on his own, I have not changed the support amount, under the assumption that if this was brought back into court I could end up with a much higher monthly tab (based on earnings changes since 1995).

    What I am considering is cutting the amount in half, continuing to send her $550 per month and banking the other $550 in case of an emergency. If I do, can I do so by simply telling her of my intentions, or do I have to go to court?

    How are his living expenses and tuition presently being paid?

    I pay his tuition and he pays his own living expenses through odd jobs worked nights and weekends. His mother maintains him on her medical insurance, which would be entirely covered by the proposed $550/month.

    You don't have the legal right to unilaterally modify court-ordered child support. All that will do is land you with an arrearage. It sounds like you have grounds to seek a modification of the present support order.
