    Default Foster Care Adoption and Custody Change in Florida

    We are non us residents and non us citizens.
    we are adopting a little boy through the foster care system in FL.
    in march we have been matched, mid till end april we were in florida for the visitation prior placement.
    everything went ok.
    unfortunately till now nothing happened in our case.
    it seems to be misunderstandings how to treat our case.
    the social worker wants first to get a passport for the child (he tried 7 weeks long and made several mistakes, so that at this point the passport is still not applied !!) and then make a date with the court to make the custody change.
    we think that a passport is not necessary to make a custody change .
    Can someone confirm that there is no reason legally to wait for the passport to get the custody of our child.

    What is the social worker's concern? Is it a question of your being eligible to stay in the country until the child has a passport, and is thus eligible to travel to Germany?

    good morning,

    I tried earlier to answer but it seems my answer is lost...
    no matter...
    I do not know exactly what is the concern of our social worker.
    If our son is not eligible to leave the US, we are till now not aware of it and nobody ever even mentioned this could be an issue.. (there are many other children who left the US being adopted abroad).
    I would definitely take the next flight to Florida when the custody change is done, that is not a problem either.
    the reason why the things do not move is that our social worker believes that the passport is necessary to get the custody changed... which we doubt....
    we would like him to go the other way round, getting the custody change first, as well as allowance to leave the US and to apply a passport, before he is applying for the passport (as it seems he is definitely the best choice for it, as he is trying during 7 weeks now, and the passport is still not applied !which means he did not apply fo custody change and so on.....)
    We are not aware of others reasons which could delay the whole process. only the fact that he thinks the passport is absolutely necessary for the change of custody.
    we are at the moment quite desesperate on this matter as it can take, if the social worker is going on with his way, many many weeks more.... this could be solved within 5 business days... for sure ... we know from other german people who have adopted in the US. first custody/placement oder, oder to leave the Us and to apply for a passport. After that with an express service passport application. Quite easy.... if....

    The issue of whether it is possible for a minor to leave the U.S. once the minor has been issued a passport, versus before the minor has a passport, is not governed by adoption law. As the U.S. State Department indicates, even children now need passports.
