    Default Underage Nude Photobooks as Art

    hey, I am curious about this subject. I was reading this post and still confused:

    and I do know that there is a photographer from 1970's named David Hamilton, and his book was full of naked under-aged people. I have seen this book at a local art library in California (i forgot which one exactly, it was several years ago while in college). I remember I used the book as a resource material to draw fairies. I do not know the title of the book though.

    Are these books actually illegal and libraries are keeping them?

    Please please please, do not bash me for asking this. This is a mere curiosity of legality because I did see this book in a library.

    There is art, and there is porn. The difference is often in the display and purpose of the images. I'm not familiar with the book you speak of, but like photos of my children that might have them in various stages of undress through the years, not every photo of a naked child is unlawful porn.

    If you feel the book unlawful report it to proper source. Outside of that no one here can say as we hav enot seen book nor do I care to

    I understand. I was merely pointing out about how in the linked post, the OP is told that

    "Yes, taking nude or sexually provoctive pic's of minors is child porn!"

    "It IS against the law to take nude ana sexually provocative pictures of a minor! End of story!"

    I was just curious how just taking a nude of minor is a crime, yet the photos of them exist in a public library. The book does not bother me, henceI did not report to anyone.

    That's an overstatement; however, if you're planning to start a business where such pictures may end up on your publicly accessible computer servers, it's best to proceed with extreme caution.

    ah thanks. I was just curious.. I don't think I will start such business since I am not a photographer, nor do i know anything about internet business. I was curious if a public library was breaking a law or not.

    my curiosity arises of an imagined scenario.

    Lets say a convicted sex offender who was in jail for molesting a young girl goes to a public library, and borrows such book (fully nude children photography "art" book).

    would that be considered a crime in the eyes of the law? What laws are there that would prevent sex offenders from obtaining such material? I guess I could go ask the librarian but I forgot which library it was.

    I think it should be illegal, just like a murderer should not be allowed to buy firearms.
